Urge Senate Judiciary Committee to Oppose Confirmation of Controversial Nominees to Lifetime Federal Judgeships

Confirmation Proceedings on Terrence Boyle, Janice Rogers Brown, and Priscilla Owen Could Spark Use of the Nuclear Option April 20, 2005 -- This Thursday, April 21, the Senate Judiciary Committee could vote on the confirmation of three of President Bush¹s most controversial "Recycled Re-Noms." Two of the nominees Janice Rogers Brown, nominated to the U.S. Court of Appeals for the D.C. Circuit, and Priscilla Owen, nominated to the U.S. Court of Appeals for the 5th Circuit are so out-of-the- mainstream that the U.S. Senate has previously rejected them. And Terrence Boyle, nominated to the U.S. Court of Appeals for the 4th Circuit, has demonstrated such hostility to civil rights that concerned senators from the 4th Circuit held his nomination from moving forward in the previous Congress. The Leadership Conference on Civil Rights urges the Senate to stand firm. Nominees with records this extreme should not receive confirmation to a lifetime seat on the federal bench! The records of these three nominees show that they are out of touch with the mainstream: Federal district court judge Terrence Boyle, nominated to the Fourth Circuit Court of Appeals, has a long history of hostility to civil rights precedents, one-sided support for states' rights, as well as an unusually high rate of reverse decisions. California Supreme Court Justice Janice Rogers Brown, nominated to the DC Circuit, has suggested that the Social Security system is unconstitutional and accused senior citizens of "blithely cannibaliz[ing] their grandchildren." Texas Supreme Court Justice Priscilla Owen, whose nomination to the Fifth Circuit was rejected by the Senate Judiciary Committee in 2002, took campaign money from Enron and Halliburton and then ruled in their favor.
